    En la Sentencia de 20 de septiembre de 2018, asunto C-214/17, Alexander Mölk c. Valentine Mölk, el Tribunal de Justicia de la Unión Europea interpreta los requisitos que establece el artículo 4.3 del Protocolo de La Haya de 23 de noviembre 2007 para que se aplique la ley del foro a las obligaciones alimenticias: es preciso que la autoridad que conoce del asunto sea la del Estado de la residencia habitual del deudor y, por otra parte, que sea el acreedor quien entable la acción. La lex fori, designada en virtud del artículo 4.3, no rige una demanda posterior interpuesta, con el fin de reducir la pensión alimenticia, por el deudor contra el acreedor ante los órganos jurisdiccionales del Estado de residencia habitual del deudor.

    In the Judgment of 20 September 2018, in case C-214/17, Alexander Mölk c. Valentine Mölk, the Court of Justice of the European Union interprets the Article 4.3 of the Hague Protocol of 23 November 2007 on the Law Applicable to Maintenance Obligations. Application of the law of the forum is subject to two conditions: first, the authority seized must be that of the State of the debtor’s habitual residence and, second, the proceedings must be instituted by the creditor. The law of the forum designated under Article 4.3, is not that law governs a subsequent application for a reduction in the amount of maintenance lodged by the debtor against the creditor with the courts of the State where that debtor is habitually resident.
