    El presente trabajo examina la figura de la inoponibilidad como principal medio de protección de los terceros en el ámbito de la regulación de los efectos patrimoniales del matrimonio. Para ello aborda el principio de protección a los terceros en el derecho civil y sus fundamentos. Desde allí realiza el análisis en el contexto de la regulación patrimonial del matrimonio, para demostrar que la inoponibilidad tiene naturaleza jurídica de mecanismo protector. El trabajo también examina críticamente las diversas hipótesis en que ella es consagrada legalmente o reconocida jurisprudencialmente y aquellas en que subsiste la necesidad de reconocerla.

    This paper examines the lack of effects as a primary figure of protection of third parties on marriage economic effects’ regulation. In order to do this, the paper deals with the third parties’ protection principle in civil law and its foundations. From this starting point the analysis is developed in the context of the patrimonial regulation of marriage. The purpose is to demonstrate that the lack of effects has legal entity of protective mechanism. The paper also examines critically several hypothesis concerning its legal enactment or acknowledgment by courts and those in which there is the need to recognize it.
