Resumen de La compensación como causa de oposición en la ejecución de títulos judiciales

l presente artículo tiene por objeto una cuestión controvertida entre las distintas Audiencias Provinciales, que tiene como consecuencia resoluciones totalmente incompatibles y sobre la que el Tribunal Supremo no se ha pronunciado para la unificación de la doctrina. La cuestión, en principio es sencilla: existen algunas Audiencias Provinciales que es sede de ejecución de títulos judiciales vienen admitiendo la compensación como motivo de oposición, frente a una mayoría de Audiencias que entienden que la misma no tiene cabida por no encontrarse expresamente prevista en el art. 556 LEC. En nuestro trabajo vamos a recoger los distintos posicionamientos existentes al respecto y argumentaremos qué postura debe de imponerse. ¿Es la compensación un motivo de oposición autónomo? O ¿Podría quedar la compensación incluida en el pago contemplado en el art. 556.1 LEC? ¿Existen supuestos en los que no pueda operar la compensación como motivo de oposición?

This article is aimed at a controversial issue between the various Provincial Courts which result in totally incompatible resolutions and on which the Supreme Court has not pronounced for the unification of the doctrine. The question, in principle, is simple: there are some Provincial Courts that are the headquarters of the execution of judicial titles are admitting the compensation as a cause of opposition against a majority of Provincial Courts that understand that it has no place for not be expressly provided for in article 556 of the LEC. In our work we are going to collect the different positions that exist in this respect and we will argue what posture should be imposed. Is compensation a reason for independent opposition? Or could the compensation included in the payment referred to in article 556.1 of the LEC be left? Are there assumptions in which the compensation cannot be operated as a cause for opposition?
