    Le Sezioni Unite, con la sentenza in commento, hanno affermato l’impossibilità di prorogare, nel giudizio di rinvio cautelare, il termine per il deposito dell’ordinanza. Gli argomenti utilizzati per giungere a queste conclusioni sono assolutamente condivisibili e possono costituire lo strumento per risolvere altre questioni interpretative che emergono dalla lettura del comma 5-bis dell’art. 311 c.p.p.

    The Joint Chambers, with the judgment in the commentary, have affirmed the impossibility of extending, in the precautionary judgement, the deadline for filing the order. The arguments used to come to these conclusions are absolutely shareable and can be used as a tool to solve other interpretative issues that emerge from reading the paragraph 5-bis of art. 311 c.p.p.
