    Este estudio analiza desde una perspectiva jurídica crítica el estado de la cuestión del derecho de los trabajadores autónomos a su salud y seguridad en el trabajo, después de 10 años de la Ley del Estatuto de Trabajo Autónomo. Del análisis del marco legal, fundamentalmente la Ley de Prevención de Riesgos Laborales y la Ley del Estatuto de Trabajo Autónomo, se señalan deficiencias, obsolescencias y omisiones de los mismos y se llama la atención sobre la necesidad de dar una respuesta específica para el trabajo autónomo y, al mismo tiempo, diferenciado para diferentes tipos de autónomos, como una realidad social cuantitativamente relevante en el contexto tecnológico y nuevas formas de organización empresarial. El balance también se extiende a las iniciativas públicas en esta área, concluyendo que a pesar de los avances, es necesario ir más allá, definiendo el contenido de un verdadero derecho público subjetivo a la provisión de servicios preventivos, junto con la obligación de autoprotección.

    This study analyzes from a critical legal perspective the state of the question of the right of self-employed workers to their health and safety at work, after 10 years of the Autonomous Work Statute Law. From the analysis of the legal framework, fundamentally the Law of Prevention of Labor Risks and the Law of the Statute of Autonomous Work, shortcomings, obsolescences and omissions thereof are noted and attention is drawn to the need to give a specific response for the work autonomous and, at the same time, differentiated for different types of self-employed, as a quantitatively relevant social reality in the technological context and new forms of business organization. The balance also extends to public initiatives in this area, concluding that despite the advances, it is necessary to move forward, defining the content of a true subjective public right to the provision of preventive services, together with the obligation of self-protection.
