Resumen de Diversidad familiar y políticas públicas: nuevos retos del Estado de Derecho

Los avances tecnológicos en materia reproductiva y los matrimonios entre personas del mismo sexo han sido factores de influencia para replantear el concepto de familia el cual ha evolucionado en los últimos años, en un principio tenía un objetivo biológico más que social, como consecuencia nacen nuevos modelos de familias que han superado el «modelo tradicional». El presente escrito tiene como objetivo realizar un estudio holístico que coadyuve, por un lado, en el ámbito legislativo para el reconocimiento de nuevos modelos familiares mediante la autonomía de esta disciplina como rama del Derecho, y por el otro la elaboración de políticas públicas incluyentes que den soporte a esta norma jurídica evitando violaciones a derechos humanos y conformando un verdadero Estado de Derecho Garantista.

Technological advances in reproductive matters and marriages between same sex have been influencers to rethink the concept of family, which evolved in recent years, initially had a biological target rather than social, as a consequence are born new models of families who have passed the "traditional model". The present paper aims to make a holistic study that contributes, on the one hand, in the legislative area for the recognition of new family models by the autonomy of this discipline as a branch of law, and on the other the creation of public policies inclusive that give support to this legal rule preventing human rights violations and forming a genuine State of law Guarantor.
