El presente trabajo se ocupa de los conocimientos especiales del funcionario público: cuáles son y qué debe hacer con ellos. Para responder a estas cuestiones realizamos una lectura restrictiva de la teoría del rol social distinguiendo conocimientos especiales formales y conocimientos especiales materiales. Los primeros son saberes obtenidos en el ejercicio de un rol diverso, su utilización en algunos casos está prohibida (deberes de confidencialidad y secreto) y en otros permitida facultativamente. Los segundos son aquellos adquiridos en el ejercicio y ocasión de la función, en un aprendizaje particular absorbido por la lógica de la institución o fortuitamente en la condición de ciudadano. Estos conocimientos emergen como presupuestos del fiel cumplimiento de la posición de garantía del funcionario público y su no activación, como regla general, acarrea responsabilidad disciplinaria y/o penal.

This work concerns itself with the special knowledge of the civil servants: which it is and what has to be done with it. To answer these questions, we carry out a restrictive reading of the theory of the social role, distinguishing between special formal knowledge and special material knowledge. The first one is knowledge gained in the practice of a diverse role, whose use is in some cases forbidden (duty of confidentiality and secrecy) and in others optionally allowed. The second one is that acquired in the exercise and practice of the duty, in a particular learning absorbed by the logic of the institution or fortuitously in the position of citizen. This knowledge emerges as assumptions of the faithful fulfillment of the guarantee position of the civil servant and its non-activation in principle leads to disciplinary and criminal liability.
