El delito de maltrattamenti contro familiari e conviventi, tipificado en el art. 572 del Código penal italiano, presenta numerosas similitudes con el delito de malos tratos habituales del art. 173.2 del Código penal español. Así, también en relación con el precepto italiano, surge el problema de acotar el ámbito de los sujetos pasivos, el de delimitar qué clase de actos pueden integrar la conducta típica, el de la posible subsunción de los comportamientos omisivos o el de la admisibilidad de la comisión por omisión, entre otros. Sin embargo, puesto que la intervención del Legislador penal italiano en este ámbito fue, en comparación con el caso español, extraordinariamente temprana, la Doctrina y la Jurisprudencia italianas cuentan con una amplia experiencia en el análisis de esta problemática, motivo por el cual su estudio puede resultar de sumo interés en orden a interpretar el tipo español.

The crime of maltrattamenti contro familiari e conviventi, typified in art. 572 of the Italian Penal Code, hasnumerous similarities with the habitual ill-treatment of art. 173.2 of the Spanish Penal Code. Thus, also in relation to theItalian precept arises the problem of limiting the scope of protected persons, of delimiting what kind of acts can integratethe typical behavior, that of the possible subsumption of omissive behaviors or of the admissibility of the commissionby default, among others. However, since the intervention of the Italian penal Legislator in this area was, in comparisonwith the spanish case, extraordinarily early, the Italian Doctrine and Jurisprudence have a wide experience in the analysis of this problem, reason why its study can be of great interest in order to interpret the spanish offence.
