El presente estudio analiza la ley de Justiniano recogida en el Codex repetitae praelectionis, 3. 1. 13, donde se regula de manera orgánica distintos aspectos del proceso de primer grado como duración, contumacia del demandante y del demandado, apelación de la sentencia contumacial, gastos procesales y sanciones por dilaciones injustificadas imputables al juez, a las partes o a sus abogados.

The present investigation analyzes the Justinian’s regulation included in the Codex repetitae praelectionis, 3. 1. 13. This flw regulates organically the different aspects of the first instance procedure, such as the length, contumacy of the plaintiff and the defendant, appeal of the contumacious judgement, legal cost and sanctions by injustified delays chargeable to the judge, the parts or the lawyers.
