Resumen de Dopaje y manipulación genética: una perspectiva jurídico-criminal

El presente artículo expone las relaciones jurídico-criminales entre el dopaje y las manipulaciones genéticas con finalidad de mejoramiento del deportista. En el ámbito del deporte, el fenómeno del dopaje tiene implicaciones socio-jurídicas que transcienden los límites del campo de juego. Por otro lado, los riesgos de las manipulaciones genéticas también se presentan como un problema contra el hombre y contra las generaciones futuras. Estos dos campos problemáticos se entrelazan cuando se erige la posibilidad del doping genético. De esta forma, se indaga, desde la perspectiva de la teoría de los bienes jurídicos, cuál debe ser el tipo penal adecuado para reglamentar las conductas practicadas entre el médico y el deportista respecto a las técnicas genéticas somáticas que estos utilizan para intentar alcanzar sus deseos de victoria.

This article points out the juridical-criminal relationship between doping and genetic engineering with the purpose of athlete enhancement. In the field of sports, the phenomenon of doping has socio-legal implications that transcend the boundaries of playing field. On the other hand, the risks of genetic engineering also present as a problem against man and future generations. These two problematic fields are intertwined when the possibility of gene doping arises. Therefore, we ask, in a protected legal interest perspective, which criminal offence is suitable to persecute the acts performed by physicians and athletes regarding somatic genetic techniques used to achieve their wishes to win.
