Abstract
The present comment is intended to analyze the international jurisdiction with regard
to labor disputes that produce as a result of the existence of an employment contract which linking
employer and employee when there are internationality elements that make necessary to resort in the
European Union scope to the new European regulation Brussels I bis. In the second part analyze
the identifying of applicable law by competent judge in the Rome I Regulation of contractual
obligations concluding what practical application has the article 1.4 of the Statute of Workers at
the present time
