Resumen de Activación del proceso ante la Corte Penal Internacional. Comparativa con la regulación en Derecho español

El procedimiento ante la Corte Penal Internacional se activa de manera contundente contra los presuntos autores de crímenes internacionales, pero respetuosa con las legislaciones vigentes en los Estados afectados. Antes de comenzar las investigaciones, la Corte llevará a cabo una serie de trámites que no existen en el proceso penal español y que están justificados para garantizar el respeto a la integridad de la soberanía de los Estados. La jurisdicción de la Corte no tiene carácter universal sino supletorio del previsto en los ordenamientos internos de los estados sometidos a ella. Por este motivo, se cuida de manera especial el control previo del inicio de las investigaciones penales. Se trata, de un lado, de no enjuiciar aquello que ya está siendo enjuiciado por un país con jurisdicción sobre el asunto y, de otro, de no comenzr una investigación si no existen indicios de veracidad suficientes a juicio del fiscal para considerar que los hechos ocurrieran tal y como se plantean ante la Corte.

The proceedings at the International Criminal Court are activated forceful but respectful manner. Before starting the research, it carry out a series of procedures that do not exist in the Spanish criminal proceedings and are justified to ensure respect for the integrity of the soverignty of States. The jurisdiction of the Court is not universal but the planned extension over the internal systems of the States subject to her. For this reason, it is very important to take special care with the previous control to the initiation of international criminal investigations. The finality is, on one side not to prosecute what is already being prosecuted for a country with jurisdiction over the matter and, on another side, to avoid any investigation if there is no evidence sufficient in the opinion of the prosecutor to consider that the facts were not as true as it were told at the Court.
