Resumen de El derecho próximo: (una reflexión sobre el entorno jurídico)

El estudio constituye una reflexión sobre la función y el papel que el Derecho juega en la sociedad. Se destacan en él su naturaleza de ciencia social y su finalidad organizadora de la convivencia. A continuación se analiza la naturaleza de la norma jurídica, diferenciándolas de las leyes físicas. Finalmente se hace un recorrido por las diferentes ramas del Derecho. El recorrido se detiene en el Derecho civil, como rama jurídica más cercana a la persona y describe las diferentes situaciones a las que se refiere: el nacimiento, el intercambio de bienes y servicios, la propiedad, la familia y el matrimonio y, finalmente, el fallecimiento y la voluntad post mortem del fallecido. Concluye con un llamamiento a la prudencia del legislador, para que utilice el sentido común a la hora de preparar las leyes.

This paper is a reflection about the function and purposes that law plays in the society.
It underlines its nature of social science and its objective of organizing the social living. After that nature of legal rule is analyzed, making differences with the physical rules. Finally it approaches to the different branches of Law. The walk stops near the so called Civil Law under continental legal system, because it is the branch nearest to the person, and describes the different situations that are referred to; birth, good and services interchange, property, family, marriage, and finally, the decease and the will. The study ends with a call to the legislator to use the common sense in the lawmaking process.
