Resumen de Los trabajadores indefinidos no fijos al servicio de las Administraciones Públicas: Una anomalía jurisprudencial y legal

    La figura de los trabajadores indefinidos no fijos al servicio de las Administraciones públicas es una creación jurisprudencial, nacida en un contexto que nada tiene que ver con el contexto en que vivimos actualmente. Este último es un contexto marcado no sólo por una crisis económica aguda y sin precedentes, sino también por una aversión social y legal a la corrupción, el fraude y la falta de transparencia. Este nuevo contexto obliga a replantearse el problema del equilibrio entre la protección del interés privado y la protección del interés público, que nuestra jurisprudencia sobre el tema resolvió decidiendo que ninguno de esos dos intereses prevaleciese sobre el contrario. Los continuos bandazos jurisprudenciales habidos en torno a la figura de los indefinidos no fijos, desde 1998 (con abundancia de sentencias de la Sala de lo Social del Tribunal Supremo, constituida como Sala General), revelan que se trata de una figura no bien encajada en el ordenamiento jurídico laboral. Con base en muy diversos argumentos —también de prevalencia de los principios constitucionales y de salvaguarda del uso de fondos públicos, siempre escasos—, este escrito propone un replanteamiento radical de la respuesta jurídica frente a la contratación temporal fraudulenta por parte de las Administraciones públicas, apuntando —de cara a cortar de raíz dicho fraude— a la necesidad de plantearse la posible nulidad total de los contratos temporales estipulados en fraude de ley por las Administraciones públicas, con posible activación al mismo tiempo del delito de prevaricación administrativa, hacia el que apunta alguna muy reciente resolución de nuestros tribunales penales.

    The figure of indefinite without tenure employees in the service of public Administrations is a creation of case-Law born in a context which has nothing to do with the context in which we nowadays live. This last is a context characterized not only by an acute and without precedents economic crisis, but also by the legal and social aversion to corruption, fraud and lack of transparency. This new context requires rethinking the problem of the balance between the protection of private interest and the protection of public interest, which our case-Law solved stating that any of those interests should prevail against the contrary. The continuous lurches occurred in our case-Law around the figure of indefinite without tenure employees, since 1998 (with plenty of decisions of the Social Chamber of our Supreme Court, constituted as General Chamber); disclose that this figure does not fit well in our labor legal order. On the basis of a number of arguments —relating also to constitutional principles and to the defence of the use of public founds, always scarce—, this paper proposes a radical rethinking of the legal answer in front of the fraudulent temporary hiring by the side of public Administrations pointing to —in face to radically cut such a fraud— the necessity of declaring the eventual total nullity of temporary contracts stipulated in fraud of law by the public Administrations, with the possible activation at the same time of the misconduct in public office crime, to which some recent case-Law of our criminal courts points out
