Resumen de A legitimidade democrática do ativismo judicial para a concretização dos direitos fundamentais

The present article analysis the question concerning to the democratic legitimacy of the judiciary to realize the fundamental rights inserted in the Federal Constitution. Therefore, it discusses about the concept and historical evolution of the fundamental rights, as well as this constitutionalization process in the charter policy of 1988, reconfiguring the own political structure of the rule of law facing the fundamental democratic principle. Sequentially, has sought to demonstrate that the theoretical-philosophical new constitucionalism movement produced the judicialization phenomenon, increesing the social demand for the judiciary performance, often activated to fill the administrative and legislative gaps. Finally, it defends that the judiciary’s activist atitude to realize the fundamental rights finds support in the Federal Constitution and legitimizes itself as authentic expression of a real democracy.

O presente artigo analisa a questão da legitimidade democrática do Poder Judiciário para a concretização dos direitos fundamentais encartados na Constituição da República. Para tanto, discorre sobre o conceito e a evolução histórica dos direitos fundamentais, bem assim seu processo de constitucionalização na Carta Política de 1988, reconfigurando a própria estrutura política do Estado de Direito face ao princípio democrático. Sequencialmente, buscou demonstrar que o movimento teórico-filosófico do neoconstitucionalismo produziu o fenômeno da judicialização, com acréscimo da demanda social pela atuação do Poder Judiciário, muitas vezes acionado para suprir as lacunas deixadas pela retração dos Poderes Legislativo e Executivo. Por fim, defendeu que a postura ativista do Poder Judiciário para concretização dos direitos fundamentais encontra apoio na Constituição da República e se legitima como expressão lídima de uma democracia real.
