Controlando al litigante rebelde: Las "anti-suit injuctions" en los tribunales españoles

Los tribunales ingleses dictan habitualmente anti-suit injunctions mediante las cuales
se ordena a un litigante que cese las actuaciones judiciales en otros foros. Este art. explora los
aspectos de Derecho internacional y español relacionados con este tipo de órdenes, incluyendo
el alcance de la prohibición en el Derecho de la UE. Este trabajo explora la posibilidad de dictar
medidas antiproceso bajo Derecho español, en los distintos casos que se pueden dar (acuerdos de
sumisión, arbitraje y conductas abusivas). Se argumenta que cuando dos partes hayan acordado la
jurisdicción exclusiva de los juzgados españoles, estos pueden dictar medidas antiproceso como
sus colegas en Inglaterra y otros países. Los casos de medidas antiproceso en el contexto del arbitraje
o en ausencia de obligaciones contractuales, sin embargo, presentan mayores dificultades.
En cualquier caso, las medidas antiproceso son remedios que pueden ser justos y útiles en ciertos

questions on international and Spanish law that arise in relation to these types of injunctions. Cases
of anti-suit injunctions in the context of arbitration or where no contractual relation exist present
more diffi culties. In any event, anti-suit injunctions are remedies that can be just and convenient
in certain cases and should not be discarded
