Resumen de Una excusa para reflexionar acerca de la delimitación entre el deportista profesional y el amateur: STSJ Galicia, de 30 de junio de 2015

El presente trabajo tiene por objeto realizar una reflexión sobre la diferencia entre el deportista profesional y el deportista amateur o aficionado. Dicha reflexión se realiza utilizando como excusa la reciente sentencia del Tribunal Superior de Justicia de Galicia, de 30 de junio de 2015. En el citado pronunciamiento la cuestión litigiosa versa en determinar la naturaleza del vínculo contractual que une a un entrenador de rugby con el club o entidad deportiva. El esclarecimiento sobre esta cuestión se realiza a partir de las pautas establecidas en unificación de doctrina por el Tribunal Supremo en la sentencia de 2 de abril de 2009. Tras esta sentencia la jurisprudencia menor ha venido aplicando tales criterios a la hora de dilucidar tal problemática. No obstante, cabe plantearse si estos criterios orientadores resuelven de un modo adecuado la delimitación controvertida entre ambos tipos de deportista.

This work aims to consider the difference among the athlete and the amateur. Such a reflection is made by using as a pretext the recent sentence of the Supreme Court of Galicia, June, 30th 2015. In the quoted pronouncement the litigious issue deals with defining the nature of the contractual link between a rugby coach and the Rugby Football Club. The explanation is carried out from the established guidelines in the Supreme Court´s unification of the doctrine in the sentence on April, 20th 2009. After this sentence the minor case-law has apply such criteria upon explaining such difficulties. Nevertheless, there is room for wandering if this illustrative criteria resolve in an appropriate way the controversial delimitation among the athlete and the amateur.
