La pensión compensatoria fijada en favor de uno de los miembros de la pareja divorciada puede ser objeto de modificación cuando existe una alteración sustancial de las circunstancias que se tuvieron en cuenta en su determinación, como un cambio importante en su capacidad económica. En este contexto, la herencia recibida por el cónyuge perceptor de la prestación puede tener consecuencias no desdeñables en la fortuna del beneficiario mejorándola sustancialmente. El hecho de recibir una herencia es una circunstancia ciertamente previsible pero en cualquier caso sobrevenida, susceptible por tanto de incidir favorablemente en la situación económica del acreedor de la pensión y en la necesidad de su modificación, según los casos

The compensatory pension determined in favour of one of the members of the divorced spouses can be modified when a substantial change happens in the circumstances which were taken into account in the determination of the pension, as could be a major shift in the economic capacity of that spouse who receives the pension. In this context, the inheritance supervening to the spouse who receives the pension may have non-negligible impact on the assets of the beneficiary by improving them substantially. The receipt of an inheritance is certainly a foreseeable circumstance but in any case is a supervening event, therefore susceptible to impact positively on the economic situation of the spouse receiving the pension and on the need of amending it, where appropriate
