Os interesses do comércio mundial que presidem à actuação da OMC estão a tomar conta da Internet. Neste trabalho, procura-se denunciar o mito de comércio eletrônico livre, através da análise da substituição das taxas públicas pelas rendas privadas no ADPIC/TRIPS, em especial no que respeita ao direito de distribuição e às exceções aos direitos de propriedade intelectual, por um lado, e da sutileza do neoprotecionismo, ora a propósito da proteção do consumidor ora a propósito da proteção da saúde pública, por outro.
The interests of the world trade, that the WTO protects, are taking over the Internet. This paper is an essay to denounce the myth of a free e-commerce by the analysis of the replacement of public taxes by private royalties, in particular in what concerns the right of distribution and the exceptions to intellectual property rights, on one hand, and the subtleness of the neo-protectionism regarding consumer and public health protection.
