El trabajo defiende la centralidad de la interpretación jurisdiccional en la génesis de toda mutación constitucional y sobre esta base, aborda la conexión entre la mutación y la interpretación en la teoría de la mutación constitucional y se exponen algunas tesis sobre la naturaleza esencialmente hermenéutica de toda operación de modificación informal de la Constitución, el protagonismo absolutamente determinante que asume la jurisdicción constitucional en la consolidación de eventuales mutaciones y, finalmente, acerca de la necesaria redefinición de la significación de esta categoría doctrinal en una Teoría de la Constitución que dé cuenta de las transformaciones producidas en el tratamiento dogmático del concepto

The paper defends the centrality of judicial interpretation in the genesis of all constitutional transformation and, on this basis, tackles the connection between transformation and interpretation in the theory of constitutional transformation and states some thesis about the essentially hermeneutic character of all operation of non-formal modification of the Constitution, the absolutely crucial role assumed by the constitutional court in the consolidation of possible transformations and, finally, about the necessary redefinition of the meaning of this category in a Theory of the Constitution that accounts for the changes prompted in the theoretical treatment of the concept
