Resumen de El mandato educativo constitucional o el espíritu de las leyes

    Con la aprobación de la Constitución de 1812 en Cádiz, se inicia en España un cambio histórico que consagraba el ideal político español de la Monarquía parlamentaria. Los liberales, verdaderos artífices de este gran avance, dieron suma importancia a la educación como progreso humano. En aquel momento, la protección a la infancia más necesitada se ofrecía bajo el enfoque de caridad privada, de forma insuficiente y en muchos casos precaria, en hospicios, asilos y casas de misericordia, dependientes, en la mayoría de los casos, de congregaciones religiosas.

    Durante todo el siglo XIX se fueron aprobando normativas legales dedicadas a clarificar y dar mayor sentido práctico a la beneficencia. Sin embargo en el último cuarto de dicho siglo, la legislación y los centros existentes no brindaban una adecuada solución a los problemas que planteaba el abandono y la orfandad de miles de niños, recibiendo duras críticas de los liberales y, en especial, de los miembros de un naciente movimiento político-social denominado "filantropía". Este movimiento proponía reorganizar la asistencia a la infancia mediante un programa basado en el refuerzo del espíritu familiar; en especial el protagonismo de la mujer, salud y educación para todos.

    Concepción Arenal y Julio Vizcarrondo fueron claros defensores de esta corriente político y filosófica que defendía un cambio en los centros benéficos de acogida infantil.

    La asistencia a los niños pobres no se debía de concretar en curar sus enfermedades, en ofrecer alojamiento, alimentación y vestimenta; sino que se debía ir más allá. La educación debía de redimirlos de la pobreza a todos por igual, enlazando la caridad privada con la beneficencia pública. Con todas las fuerza unidas, se proporcionaría un cuidado y educación de todos los niños sin distinción alguna, para que, posteriormente, se incorporaran a la naciente sociedad industrializada que se desarrollaba en aquellos momentos.

    With the approval of the Constitution of 1812 in Cadiz, there begins in Spain a historical change that there was dedicating the ideal Spanish politician of the parliamentary Monarchy. The liberal, real makers of this great advance, gave supreme importance to the education as human progress. In that moment, the protection to the neediest infancy was offering under the approach of private charity, of insufficient form and in many cases precarious, in hospices, asylums and houses of mercy, dependent in most cases of religious congregations.

    During all the 19th century legal regulations were approved dedicated to clarifying and giving major practical sense to the welfare. Nevertheless, in the last quarter of the above mentioned century the legislation and the existing centers, they were not offering a suitable solution to the problems that there was raising the abandon and the orphanhood of thousands of children, receiving hard critiques of the liberal ones and, especially, for the members of a nascent political and social movement named "philanthropy". This movement was proposing to reorganize the assistance to the infancy by means of a program based on the reinforcement of the familiar spirit; especially the leading role of the woman, health and education for all.

    Concepción Arenal and Julio Vizcarrondo were clear defenders of this current politician and philosophical that was defending a change in the charitable centers of infantile reception. The assistance must not make concrete the poor children in treating his diseases, in offering housing, supply and gown; but it had to go beyond. The education have redeeming from the poverty to all equally, connecting the charity deprived with the public welfare. With all it forces them joined, one would be provided care and education of all the children without any distinction, in order that, later they were joining to the nascent industrialized company that was developing in those moments.
