La Directiva 2011/83/UE constituye una importante contribución normativa de la Unión Europea a la protección de los consumidores. En este trabajo se examina la finalidad de la Directiva, su ámbito de aplicación subjetivo y objetivo, y cuál es la materia objeto de armonización. Se estudia el alcance del principio de armonización plena que acoge la Directiva, y el papel que se concede a los Estados miembros para, a la hora de incorporarla, decidir separarse de las reglas de la Directiva o establecer el alcance de algunas previsiones comunitarias.
The Directive 2011/83/UE is an important normative contribution of the European Union to the protection of consumers. This paper examines the purpose of the Directive, its subjective and objective field of application, and which is the subject proposed of harmonization. It examines the extent of the principle of full harmonization that the Directive admits, and the role that is granted to the Member States, to opt out from the rules of the Directive or to establish the scope of some community regulatory provisions, when transposing the Directive.
