    La extensión de la protección por medio de patentes a todos los sectores tecnológicos, por medio del Acuerdo ADPIC, reforzó notablemente la protección de los productos farmacéuticos en el ámbito internacional. Sin embargo, ha de resaltarse el impacto que generan estas medidas sobre el comercio internacional de medicamentos, particularmente sobre la accesibilidad a los mismos. Debido al potencial impacto que conlleva esta situación sobre el cumplimiento del derecho a la salud se torna imprescindible efectuar una revisión minuciosa de las opciones previstas en el Acuerdo ADPIC, que permitan sortear los obstáculos y las falencias del sistema instaurado. Es así como el propósito fundamental de la presente investigación, se dirige a introducir al lector en el análisis de los principales problemas respecto a la implementación de estas medidas y sus posibles soluciones.

    The promotion of a greater extent of patent protection to all inventions regardless their technology field, throughout the TRIPS Agreement, contributed substantially to strengthen the international protection of pharmaceutical products. However, it is particularly notably the impact generated by the implementation of these measures over the international trade of medicines, especially regarding access to medicines issues. Due to the potential impact this situation may have over the fulfillment of the right to health, it turns mandatory to conduct a detailed survey about the options provided by the TRIPS Agreement, which may lead to overcome the different obstacles and main failures of the established system. Given this, the main purpose of this paper is to introduce the reader into the analysis of the primary topics regarding the enforcement of these policies, as well as its possible solutions.
