    En este artículo examinamos el sentido kantiano del castigo y su reformulación en la problematización foucaultiana del derecho de castigar, que es en gran medida una crítica de la concepción kantiana. Luego presentamos la concepción de una justicia restaurativa fundamentada en el ideal social del reconocimiento;

    la cual corrige ciertos aspectos de la concepción kantiana pero le confiere a la justicia su estatus de institución, sin quedarse solamente en criticarla.

    In this paper we study the kantian conception of punishment in the Metaphysics of Morals. We look at Foucault�s reformulation of the right to punish which is mostly a critique of the kantian conception.

    Then we introduce the conception of restorative justice grounded on the social ideal of recognition, which corrects certain aspects of the kantian conception, but gives to justice its status of an institution rather than being a critique of it.
