Régimen urbanístico de la implantación de grandes establecimientos comerciales en Castilla y León

    Las consecuencias de la trasposición de la Directiva de servicios se extienden al régimen de implantación de los grandes establecimientos comerciales. En el caso de Castilla y León, a partir de las bases sentadas por las leyes estatales de trasposición de esa norma comunitaria, incluida reforma de la Ley de Ordenación del Comercio Minorista, el legislador autonómico ha modificado aspectos sustanciales de la Ley de Comercio de Castilla y León, derogando también el instrumento de ordenación territorial regulador del equipamiento comercial de la Comunidad y, por último, aprobando la denominada Norma Técnica Urbanística sobre Equipamiento Comercial, en este último caso para establecer las pautas a seguir por los titulares de la potestad de planeamiento en lo referente a la implantación de los grandes establecimientos comerciales. Del estudio de esta última disposición y, por lo tanto, del régimen jurídico urbanístico de la implantación de los grandes establecimientos comerciales nos ocupamos en el presente trabajo, el cual, por su contenido, toma como punto de partida las claves de la evolución del urbanismo comercial que fueron objeto de estudio por nosotros mismos con anterioridad.

    The consequences of the transfer of the services Directive affect the regime for setting up large commercial establishments. In the case of Castile and Leon, starting from the basis of the State laws of transfer for this EU regulation, including the reform of the Retail Business Regulation Law, the autonomic, regional legislator modified substantial aspects of the Law of Commerce of Castile and Leon, also abolishing the territorial instrument that regulated the Community�s commercial services and, finally, approving the so-called �City Planning Technical Regulations on Commercial Services� in order to establish the guidelines to be followed by those responsible for planning with respect to the setting up of large commercial establishments. This paper deals with the study of the latter disposition and, thus, with the legal regime for city planning concerning the setting up of commercial establishments and which, due to the contents, takes the key questions in the evolution of commercial city planning, which were the object of previous studies by the author, as the starting point.
