El derecho a la educación.: Su alcance, exigibilidad y relevancia para la política educativa

    Este ensayo, además de ofrecer información acerca de la evolución del derecho a la educación en el plano internacional y de la manera en que este derecho está consignado en la legislación de México, examina dos aspectos particulares: por una parte, su exigibilidad y los problemas que enfrenta; por otra, la relación que debiera tener la política educativa con él, ya que este derecho está en la base de las obligaciones del Estado en materia educativa. El autor termina formulando una propuesta al Instituto Nacional para la Evaluación de la Educación con objeto de que reorganice sus indicadores en este sentido y atienda también a facilitar la exigibilidad del derecho a la educación. Este trabajo es una invitación a los investigadores de la educación a incluir estas temáticas en sus agendas de investigación.

    Abstract:

    This essay, in addition to offering information on the evolution of the right to education at the international level, and the way this right is established in Mexico�s legislation, examines two particular aspects: on one hand, its enforceability and the problems faced; and on the other hand, the relation educational policy should have with the right to education, given that this right is based on the state�s obligations in education. The author concludes by formulating a proposal for the National Institute for the Evaluation of Education to reorganize its indicators in this regard and facilitate the enforceability of the right to education. The article extends an invitation to educational researchers to include these topics on their research agendas.
