La delegación de la potestad judicial 'decisoria' y la reconvención en las causas de nulidad del matrimonio tras la Instr. 'Dignitas connubii'. Breves notas

Abstract

Algunos autores afirman que la prohibición de delegar la potestad judicial 'decisoria' (c. 135 § 3) incluye a los obispos diocesanos (los titulares de la potestad ordinaria propia). No obstante, el CIC (y el CCEO) permite al obispo diocesano delegar la potestad judicial 'decisoria' al referirse explícitamente en dos ocasiones a los jueces o tribunales delegados de los obispos diocesanos: cc. 1495 y 1512, 3º. Estas normas carecerían de sentido sin la posibilidad de la delegación en cuestión. La prohibición de delegar la potestad judicial 'decisoria' se refiere sólo a los titulares de la potestad judicial 'vicaria'. A la modalidad típica de la reconvención clásica, la 'compensatoria', el CIC y el CCEO han añadido otra modalidad fundada en la conexión objetiva de las causas. Dicha conexión permite su utilización en las causas matrimoniales. ------ Some authors affirm that the prohibition to delegate the judicial power to pronounce sentence (cc. 135, 3) includes the diocesan bishops (titulars of the proper ordinary power). However, the CIC (and the CCEO) allows the diocesan bishop to delegate the judicial power to pronounce sentence, referring explicitly in two occasions to the judges or tribunal delegates of the diocesan bishops: cc. 1495 and 1512, 3. These norms would lack any sense without the possibility of the delegation in question. The prohibition to delegate the judicial power to pronounce sentence refers only to the titular of the vicarious judicial power. To the typical modality of the classical reconvention, the compensatory, the CIC and the CCEO have added another modality founded on the objective connection of the cases. The said connection allows its use in matrimonial cases.
