"Consortium omnnis vitae": una reflexión sobre derecho matrimonial comparado

    La finalidad de este artículo es subrayar la importancia del consortium omnis vitae (comunidad de vida, «Lebensgemeinschaft») para la comprensión del Derecho Matrimonial, y esto frente al punto de vista tradicional que atiende sólo al comienzo (contrato matrimonial) y al final del matrimonio (muerte o divorcio). Profundizando en las relaciones que fluyen del consortium omnis vitae, no sólo se revela la naturaleza del matrimonio, sino también el paso desde el divorcio por culpa al divorcio por crisis matrimonial irrecuperable. La idea de consortium omnis vitae es esencial para comprender la razón de fondo del incremento de la cohabitación en nuestros días, porque el consortium es también la clave para entender la dimensión social del matrimonio, frente al enfoque unidimensional, que toma en cuenta sólo el comienzo y el final del matrimonio.

    The aim of this paper is to stress the paramount importance of the consortium omnis vitae (living together, «Lebensgemeinschaft») for the right understanding of the Law of marriage, and this in front of the traditional view that focuses only at the beginning (contract of marriage) and at the end of marriage (dead or divorce). Understanding the relationships that flow from the consortium omnis vitae not only disclose the nature of the marriage, but also the passage from the divorce by fault to the divorce by irretrievable breakdown. The idea of consortium omnis vitae is essential to grasp the background of increasing cohabitation in our days, even because the consortium also pinpoint at the social dimension of marriage, in front of a unidimensional contemplation, that bear in mind only beginning and end of the marriage.
