Resumen de David frente a Goliat: el superior interés del menor y el derecho a la tutela judicial efectiva en tela de juicio

El asesinato de una niña a manos de su padre, al haberle sido retirada contra la voluntad de su madre la vigilancia en las visitas, lleva a cuestionar si, en toda situación conflictiva, prima realmente el superior interés del menor. Doce años de batalla judicial por parte de aquélla dieron como resultado que el Comité de Naciones Unidas para la Eliminación de la Discriminación contra la Mujer (CEDAW) condenara al Estado español por negligencia en la protección de la menor. España se negó a admitir la resolución de este órgano de control negando valor ejecutivo a la resolución y, en consecuencia, a indemnizar a la madre por anómalo funcionamiento de la Administración de Justicia. No ha sido hasta 2018 cuando el Tribunal Supremo ha considerado que el Estado ha incumplido el mandato constitucional que le obliga a la tutela judicial efectiva y que, por ello, es responsable de ese anormal funcionamiento, teniendo que hacer frente a una indemnización por los perjuicios sufridos por la mujer.

The murder of a girl in the hands of her father, after surveillance during visits was withdrawn against her mother’s will, leads to the question of whether, in any conflictive situation, the best interest of the child really prevails. Twelve years of judicial struggle on her part resulted in the United Nations Committee on the Elimination of Discrimination against Women (CEDAW) con-demning the Spanish State for negligence in the protection of the child. Spain refused to admit the resolution of this control body, denying executive value to its opinion and, consequently, to compensate the mother for the anomalous functioning of the Administration of Justice. It has not been until 2018 that the Supreme Courthas considered that the State has failed to comply with the constitutional mandate that obliges effective judicial protection and that,therefore, it is responsible for this abnormal functioning, having to face compensation for the damages suffered by the woman.
