This study addresses the historical path of decision-making standards in Brazil, the way in which jurisprudence gained space at the expense of not being a formal source of Law, Laws were created that ensured that jurisprudence had a breadth that mitigated the limits of separation of Three Powers. Therefore, the question we intend to answer is the following: To what extent can Jurisprudence take the place of the Law? What is the limit between giving adequate interpretation to Laws and using jurisprudence as a form of legislation? Through this study it will be possible to verify the development of this theme. The research includes a review of specialized literature and an approach to different models of constitutional jurisdiction. The conclusions highlight that Law is a Science and as such, there are standards and rules and ethical issues to be respected. Legal argumentation, despite the pluralism of voices that sustains it, according to Castanheira Neves “is a practical thought that emphasizes the conditions and types of possible argumentation, converging with each other in the search for a consensus on the criteria (topoi) essential so that certain problems can be resolved” (Neves, 2011).
