    La sentencia comentada se pronuncia sobre la validez y eficacia de un poder preventivo con cláusula de subsistencia no inscrito en el Registro Civil y desprovisto de controles y salvaguardas, tanto de carácter voluntario como legal, al haberse otorgado antes de la entrada en vigor de la Ley 8/2021. El Tribunal Supremo concluye que la inscripción registral no tiene carácter constitutivo y que el poder preventivo es medida de apoyo suficiente pese a la falta de mecanismos voluntarios o legales de control y salvaguarda, dado que siempre cabe establecer controles o salvaguardas judiciales, lo que determina la no procedencia de la constitución judicial de la curatela.

    The commented judgment rules on the validity and efficacy of the power of attorney with a subsistence clause not registered in the Civil Registry and devoid of controls and safeguards, both of a voluntary and legal nature, having been granted before the entry into force of Law 8/2021. The Supreme Court concludes that registration does not constitute a constitutive requirement and that the power of attorney is a sufficient support measure despite the lack of voluntary or legal control and safeguard mechanisms, given that it is always possible to establish judicial controls or safeguards, which determines that the judicial constitution of the curatorship is not appropriate.
