  • Within the current jurisprudential literature, two main theories of interpretation nowadays compete - the hermeneutic and the analytic. The analytic theory, in turn, is divided between a neo-cognitivist and a realistic stand. The Author, after sketching out the main tenets of such competing accounts of legal interpretation, defends the realistic theory as a purely descriptive attitude toward, and a true picture of, the actual practice of judges and legal scholars.
