This brave new world of big health data it´s an incognito. The purpose of this paper is to analyze the European legal framework in the transdisciplinary field of eHealth, personal data, privacy values and potential eHealth profiling abuses. Advancement and improvement of information and communication technology have changed health care system. Electronic health sector (eHealth) is a sensitive issue, demanding therefore the same level of innovation and security, not only to collect, store and analyze health data, but also in any regards related to medical care and investigation. The development, implementation and use of Electronic Health Records system has been especially stimulated, giving raw material to big health databases. In this sense, it’s secure to say that its growth raises tremendous concerns regarding privacy rights. Especially when it comes to correlate sets of personal health data and extract them attributes, biometric features and characteristics to identify a person (personalized profiling), to predict his future behavior or attitudes (eHealth profiling). It’s a critical challenge with rights and wrongs.
