Resumen de Circulación de ideas jurídicas y génesis del derecho social en Chile (1890-1914): Anton Menger (Austria, 1841-1906), Adolfo Posada (España, 1860-1944) y Valentín Letelier (Chile, 1852-1919)

  Resumen El artículo examina la transferencia de ideas socio jurídicas entre Europa e Hispanoamérica, a través de la figura de tres importantes juristas en sus respectivos países: el austriaco Anton Menger (1841-1906), el español Adolfo Posada (1860-1944) y el chileno Valentín Letelier (1852-1919). Lo anterior, en el marco de génesis del derecho social en Chile (1890-1914) y como parte de un proceso de alcance global denominado “socialización del derecho y sociologización del pensamiento jurídico”, que comenzó en las últimas décadas del siglo XIX. Para comprender esta circulación se ofrece una silueta de estos tres juristas, especialmente de su pensamiento jurídico, con miras a situar sus diferencias y, sobre todo, sus conexiones. Después se analizan las principales ideas jurídicas que fluyen del texto mengeriano, El derecho civil y los pobres, tarea necesaria para interiorizarse tanto en la difusión de esta obra a manos de Posada y Letelier como en las relaciones, a partir del texto precitado y otros antecedentes, entre estos tres juristas.

  Abstract The article examines the transfer of social and legal ideas between Europe and Hispanic America, through the figure of three important jurists in their respective countries: the Austrian Anton Menger (1841-1906), the Spanish Adolfo Posada (1860-1944) and the Chilean Valentín Letelier (1852-1919), within the framework of the genesis of social law in Chile (1890-1914) and as part of a process of global scope called “socialization of the law and sociologization of legal thought”, which began in the last decades of the 19th century. To understand this circulation, a silhouette of these three jurists is offered, especially their legal thinking, in order to establish their differences and, above all, their connections. Then the main legal ideas that flow from the Mengerian text, Civil Law and the Poor, are analyzed, which is necessary to internalize both in the dissemination of this work at the hands of Posada and Letelier and in the relationships, based on the aforementioned text and other antecedents, among these three jurists.
