El objeto de análisis es la incipiente regulación del delito de los que rehúsan al estado los servicios que le deben, incluyéndolo en el Código Penal de 1822. Para llevarlo a cabo se tiene en cuenta las circunstancias que provocan esta regulación, analizando el impacto en el contexto de su época.
Intentando optimizar la recaudación para poder cubrir la necesidad de obtener los fondos necesarios de la administración pública de entonces. En España se produjo una profunda transformación política que posibilitó la modernización de nuestro país, su entrada en el mundo contemporáneo. Tengamos en cuenta que durante este siglo se pasó de una monarquía absolutista, sin libertades, a un régimen parlamentario y liberal. El cambio de régimen no fue sencillo, sino que constituyó un largo proceso de promulgación y anulación de textos constitucionales, conspiraciones, pronunciamientos militares, con frecuentes enfrentamientos armados entre partidarios de distintas ideas.

The object of analysis is the incipient regulation of the crime of those who refuse the state the services owed to it, including it in the Penal Code of 1822. To carry it out, the circumstances that cause this regulation are considered, analyzing the impact in the context of its time. Trying to optimize the collection to cover the need to obtain the necessary funds from the public administration of the time. Spain underwent a profound political transformation that made possible the modernization of our country, its entry into the contemporary world. During this century, Spain went from an absolutist monarchy, with no freedoms, to a parliamentary and liberal regime. The change of regime was not simple but constituted a long process of promulgation and annulment of constitutional texts, conspiracies, military pronunciamientos, with frequent armed confrontations between supporters of different ideas.
