La cuestión de la eficacia de los Derechos Fundamentales en las relaciones jurídicas entre sujetos jurídico-privados, resulta de la máxima importancia y utilidad práctica para la realidad jurídica democrática de presente y de futuro, pues se trata de la problemática estimada «cabecera» en el ámbito de la dogmática iusfundamental. La Drittwirkung der Gundrechte es ya, efectivamente, la función primaria desempeñada por los mismos, toda vez las vulneraciones más graves de su haz de garantías no son imputables solo a los poderes públicos, sino que provienen asimismo de fuertes poderes sociales de dominio; y es un tema crecientemente polémico ante la inexistencia de una construcción dogmática o jurisprudencial clara y unitaria.

The question of the effectiveness of Fundamental Rights in the legal relationships between legal-private subjects, is of the utmost importance and practical utility for the democratic legal reality of the present and of the future, since it is the problem considered «head» in the field of fundamental ius dogmatics. The Drittwirkung der Gundrechte is already, effectively, the primary function performed by them, since the most serious violations of their bundle of guarantees are not attributable only to the public powers, but also come from strong social powers of dominance; and it is an increasingly controversial issue in the absence of a clear and unitary dogmatic or jurisprudential construction.
