Resumen de ¿Citius, altius, fortius?: Derecho internacional de los derechos humanos y protección de deportistas transgénero e intersexuales

El objetivo de este trabajo es reflexionar sobre cómo pueden conciliarse dos objetivos previstos por el Derecho internacional: la prohibición de discriminación por razón de identidad de género, de un lado, y la integridad de las competiciones deportivas, de otro. Las ideas de dignidad y no discriminación, dos de los pilares sobre los que se construye el Derecho Internacional de los Derechos Humanos (DIDH), han guiado el avance, lento y tardío, de la protección de las personas en las que se centra el estudio: las personas transgénero o con desarrollo sexual diferenciado. El Derecho internacional, por otra parte, parece haber asumido que la necesaria protección de la integridad de las competiciones deportivas justifica la limitación de derechos fundamentales. En este contexto, parece oportuno analizar si la participación de estos/as atletas en competiciones deportivas puede limitarse sobre la base del DIDH y, en su caso, el alcance de dicha limitación.

The aim of this paper is to reflect on how two objectives of international law can be reconciled: the prohibition of discrimination on the grounds of gender identity, on the one hand, and the integrity of sporting competitions, on the other. The ideas of dignity and non-discrimination, two of the pillars on which International Human Rights Law (IHRL) is built, have guided the slow and belated progress in the protection of the people on whom the study focuses: transgender or sexually differentiated athletes. International law, on the other hand, seems to have already assumed that the necessary protection of the integrity of sporting competitions justifies the limitation of fundamental rights. In this context, it seems appropriate to analyse whether the participation of these athletes in sports competitions can be limited under IHRL and, if so, the extent of this limitation.
