  Crear un marco constitucional que permitiera encajar el papel institucional de las fuerzas militares dentro del Estado liberal que España trataba de construir tras la Guerra de Independencia supuso uno de los mayores desafíos que hubieron de afrontar los constituyentes en la primera mitad del siglo. Las diferentes constituciones, y otras normas vinculadas al sistema constitucional, como la Ley Constitutiva del Ejército, de 1821, tratando de encontrar diseñar este marco, que dejó de sufrir modificaciones a lo largo de los sucesivos procesos transicionales.

  Creating a constitutional framework that would allow the institutional role of the military forces to fit within the liberal state that Spain was trying to build after the War of Independence was one of the greatest challenges that constituents had to face in the first half of the century. The different constitutions, and other norms linked to the constitutional system, such as the Constitutional Law of the Army, of 1821, trying to find a design for this framework, which ceased to undergo modifications throughout the successive transitional processes
