Resumen de La teoría de las fuentes del Derecho del Estado constitucional

  Este estudio es, en primer término, un homenaje a Antonio Ruggeri, destinado a los Scritti en su honor. Pero también lo es a los iuspublicistas italianos, que contribuyeron decisivamente a la construcción de la teoría de las fuentes del Estado constitucional, que es lo mismo que decir a la construcción del Estado constitucional. Se exponen algunos ejemplos significativos que afectan a aspectos claves de la teoría de las fuentes del Estado constitucional. Desde los propios fundamentos del sistema en la contraposición entre legitimidad y efectividad, hasta la configuración del orden jurídico entre sistema y ordenamiento jurídico, pasando por la diferenciación entre disposiciones y normas, la configuración de la validez y la eficacia de las normas o la propia determinación de las fuentes del Derecho, encontramos en la doctrina italiana de las fuentes referentes fundamentales para comprender la naturaleza y la estructura del Estado constitucional de Derecho en su vertiente específicamente normativa.

  This paper is, in the first place, a tribute to Antonio Ruggeri, destined to the Scritti in his honor. But it is also an essay about the Italian iuspublicistas, who contributed decisively to the construction of the theory of the sources of law in the constitutional State, which is the same as saying to the construction of the constitutional State. Some significant examples that affect key aspects of the theory of the sources of the constitutional state are presented. We find in the Italian jurisprudence topics related to the very foundations of the system in the contrast between legitimacy and effectiveness, the configuration of the legal order as a system, the differentiation between depositions and norms, the configuration of the validity and effectiveness of the norms or the determination of the concept “sources of law”. In all this matters, we find in the Italian doctrine the fundamental referential ideas to understand the nature and structure of the constitutional State in its specifically normative aspect.
