La jurisprudencia del Tribunal Europeo de Derechos Humanos se ha visto sujeta a una cierta evolución respecto de la interpretación de la cláusula ne bis in idem del artículo 4 del Protocolo 7, estableciendo que nadie puede ser sancionado dos veces por la misma infracción. Esta interpretación ha versado sobre todo sobre los dos elementos esenciales del principio: por un lado, sobre qué debe entenderse por la misma infracción (idem); por otro, en qué consiste el doble ejercicio del ius puniendi (bis). Los dos puntos clave en la evolución de la jurisprudencia del Tribunal son los representados por la sentencia en el caso Zolothukin c. Rusia, del año 2009, en lo que se refiere a la definición del idem, y por la sentencia en el caso A y B c. Noruega, del año 2016, con respecto a la interpretación del bis.
The case law of the European Court of Human Rights has been subject to a certain evolution concerning the interpretation of the ne bis in idem clause of Art. 4 of Protocol 7, establishing that no one can be punished twice for the same offence. This interpretation has dealt mainly with the two essential elements of the principle: on the one side, what must be understood as the same offence (idem); on the other, what is the meaning of a double exercise of the ius puniendi (bis). The two main steps in the evolution of the Court’s case law on the matter are represented by two judgments.The first one, pronounced in the case Zolothukin v. Russia, of the year 2009, concerns the definition of the idem; the second one, on the case A and B v, Norway, refers to the interpretation of the bis.
