Resumen de El proceso cautelar en materia de sustracción internacional de menores

El presente trabajo analiza el proceso cautelar y las concretas medidas que pueden adoptarse en los procesos sobre sustracción de menores, en un doble plano: cuando un menor es trasladado ilegalmente a España por uno de los progenitores y se solicita su restitución inmediata al país en el que residía habitualmente antes del traslado. De otro lado, se analiza también el proceso cautelar y las medidas que pueden adoptarse cuando exista el riesgo de que un menor que reside habitualmente en España pueda ser trasladado por uno de los progenitores o alguien de su entorno a otro país. En este caso pueden ser varios los procedimientos principales que pueden seguirse sobre custodia y protección de menor, existiendo también distintas vías para asegurar la efectividad de la sentencia que en su día pueda dictarse.

This paper analyzes the precautionary process and the specific measures that can be taken in proceedings on child abduction, on two fronts: when a child is transferred illegally to Spain by one parent and immediate restitution is requested to the country in which the child was habitually resident before the transfer. On the other hand, it also analyzes the precautionary process and the measures that can be taken when there is a risk that a child habitually resident in Spain can be transferred by a parent or someone close to one of his/her parents to another country. In this case there may be several main procedures that can be followed on custody and protection of minors and there are also various ways to ensure the effectiveness of the judgment that a court might rule.
