Resumen/Abstract
Desde su introducción en el Código penal, el delito de prevaricación urbanística ha permanecido inalterado hasta el año 2010 cuando fue reformado por LO 5/2010, de 22 de junio, que introdujo dos novedosas modalidades omisivas típicas. Estas novedosas modalidades omisivas de prevaricación urbanística del art. 320.1 CP nacieron con una clara vocación de combatir la inactividad de autoridades y funcionarios públicos encargados de velar por la legalidad urbanística y que, por falta de interés o/y medios permitieron la generalizada indisciplina urbanística que ha traído nefastas consecuencias para el orden económico, ambiental, fiscal y político, menoscabando, incluso, la credibilidad del Estado español frente a la comunidad internacional.
En vista de la nula aplicabilidad judicial y el escaso interés doctrinal que han despertado las conductas típicas omisivas del art. 320.1 CP y de los efectos criminógenos que genera la ley promulgada y no aplicada, la presente investigación pretende abordar, desde una perspectiva dogmática, el análisis de las cuestiones más trascendentales que el delito omisivo de prevaricación urbanística suscita, con el propósito de identificar los problemas dogmáticos y, quizás, también, político-criminales que anulan su virtualidad práctica.
The urban prevarication crime contained in the art. 320 CP, was first introduced in our criminal law by LO 10/1995, of November 23, of the Penal Code; the law that approved a new Penal Code for Spanish democracy. Since its introduction in the Penal Code, the urban prevarication crime has remained unchanged until 2010 when it was reformed by LO 5/2010, of June 22, which introduced two new typical omissions modalities. After ten years of validity, the effectiveness of those new omissions modalities of urban prevarication crime has been shown to be rather symbolic than real and this is not surprising in view of the problems posed by the typical structure of omissions prevaricating of art. 320.1 CP. In view of the null judicial applicability and the little doctrinal interest that the typical omissions of art. 320.1 PC and the criminogenic effects generated by the enacted and not applied law, this research aims to address, from a dogmatic perspective, the analysis of the most important questions that the omission of prevarication urban crime raises, in order to identify the problems dogmatic and, perhaps, also, political-criminals that nullify their practical effectiveness.
