    El objetivo de este trabajo es abordar el tema de la responsabilidad del Estado-Juez, desde una perspectiva diversa a la que tradicionalmente se ha analizado. En efecto, el autor estudia la eventual generación de perjuicios o daños a los justiciables derivados de los actos administrativos del poder judicial, con el consecuente surgimiento de responsabilidad patrimonial del Estado. Para ello, se incorpora, en términos genéricos, el concepto, hasta ahora desconocido en nuestro medio, de la figura de anormal funcionamiento de la administración de justicia, como título de imputación de responsabilidad y su posible tratamiento en el ordenamiento jurídico chileno.

    The aim of this paper is to expose the liability of the State Justice from a different perspective than that from which it has been traditionally analyzed. In effect, the author examines the eventual generation of hurts or damages to the litigants deriving from the administrative acts of the Judiciary, with the consequent arising of financial liability of the State. In order to do that, in generic terms, it incorporates the concept, unknown until now in our law, of justice administration abnormal functioning, as a cause of imposition of liability and its possible treatment in the Chilean legal system.
