    n este estudio se abordará el instituto del agotamiento de la vía administrativa desde una perspectiva com- parada, histórica y analítica. Partiendo de la base de que los derechos no son absolutos y el legislador puede configurar en forma razonable su instrumentación, pretendemos demostrar la racionalidad del agotamiento de la vía administrativa siempre que se de- sarrolle en un contexto estructural normativo, material y humano adecuados.

    De lo contrario, el propio sistema debería contener la vál- vula que admita, sin dilaciones, el acceso a la justicia. Puntualmente, en casos con- cretos, el juez debe interpretar y valorar la utilidad del agotamiento. Frente a la duda o ante cualquier �retardo injustificado�, por cualquier razón , se deberá prescindir de agotar la vía administrativa antes de acceder a la justicia

    This work will address the institute of exhaustion of administrative remedies from a comparative, historical and analytical perspective.

    On the basis that the rights are not absolute, and the legislator can configure in a reasonable way its instrumentation, we intend to demonstrate the rationality of the exhaustion of administrative remedies whenever is developed in an adequate structural normative, material, and human context.

    Otherwise, the system itself should contain the valve that supports, without delay, the access to justice.

    Promptly, in specific cases, the judge must interpret and assess the usefulness of exhaustion. In case of doubt or �unwarranted delay�, for any reason, it should be dispensed with to exhaust administrative remedies before access to justice.
