    • Before tlze enactment of the Law 38/99 of the 5th November for the Town Building Process Ordinarzce, responsibility during /he buildiizg process ivas compulsory applazing the article 1591 qf the Civil Code, based on a very ample concept of jurisprudential ruin ,for which the bnilding agents were denzanded a contractual responsibilit);, with ass~tmptiono f guilt and consideration of deadline berween ten andfifteen yeavs us a time limit guarantee, difJerent from tlze yrescription deadline or the practice ofrhe responsibility acriorz.

      The Luw 38199 clearly regulates tlze responsibility of those agerzts in article 17, concerning material damage in /he building observing tlze deadline in /he Law (structure, piocess of building or ending upj date work ending and witlz a prescription limit of two years.

      This new regulation, which obviates any refererzce to urticle 1591 of the Civil Code, /he only applicable until /he coming into force of the Law 38/99 and upon which /he Jurisprudence of /he Supreme Court stuted a whole theory of responsibility for ruin, brings up the isscte of its implicit revocation, its validit); or even the complementary accordarzce of both regulations
