La jurisprudencia del amparo económico: los tres grandes déficit la última década

    El trabajo evalúa la jurisprudencia de amparo económico en la última década (20012012), identificando los tres grandes déficits que le han restado eficacia. Los dos primeros, ya han sido abordados por la doctrina, y se les somete a nuevo examen. Tales son la reducción del ámbito de la acción al solo inciso segundo del artículo 19 N° 21 y la limitación de la sentencia al efecto declaratorio de mera certeza. A lo anterior se suma un tercer déficit que consiste en la formulación inadecuada de la denuncia. Es habitual que los denunciantes no consideren con suficiencia que el derecho a desarrollar una actividad económica debe "respetar las normas legales que la regulen", lo que predetermina los resultados negativos del fallo

    The work assesses the jurisprudence of the appeal to protect the right to engage economic activities in the last decade (2001-2012), identifying the three large deficits that have diminished its effectiveness. The two first, that have already been addressed by the doctrine, are now subjected to further review. These are the reduction of the scope of the legal action to the only article 19 N° 21 second subparagraph and the limitation of the judgment to the declaratory effect of mere certainty. This adds a third deficit involving the improper formulation of the referred legal action. It is usual that the complainants do not consider with sufficiency that the right to develop an economic activity must "respect the legal rules governing it", which predetermines the negative results of the judicial decision
