La inelegibilidad del analfabeto en Brasil: por una lectura más democrática

    El texto constitucional brasileño prescribe que los analfabetos son inelegibles.

    Independientemente de la crítica que esta restricción merece, en ciertos casos es difícil decir si una persona es inelegible o no, pues el término �analfabeto� tiene contornos imprecisos. Este trabajo pretende investigar cómo ha sido concretizada la inelegibilidad del analfabeto en Brasil. La hipótesis que se tiene es que el concepto de analfabeto puede variar según la circunscripción electoral y también según el cargo electivo en discusión. Se opta, entonces, por realizar este estudio a partir de la teoría de la concretización, según la cual la norma es el resultado de un proceso de concretización, donde actúan, además del referencial lingüístico del precepto jurídico, las circunstancias de hecho relacionadas con el caso concreto. Esto permitirá interpretar la inelegibilidad del analfabeto según el contexto que se expone.

    The Brazilian Constitution establishes that illiterates are ineligible. Despite of the disapproval of this restriction, in some cases it is difficult to know whether a person is ineligible or not, because the term �illiterate� assumes vague outlines. This work aims to investigate how it has been concretized the ineligibility of the illiterate in Brazil. The hypothesis we have is that the concept of illiterate can vary according to the constituency and also in accordance with the elective office under discussion. Then, this study is based on the concretion theory, which says that the norm results from a process of concretion, where, in addition to the legal precept, the factual circumstances relating to case also works. This allows us to interpret the ineligibility of the illiterate according to the context.
