    Con el presente artículo se busca aportar al debate nacional sobre la materia de la responsabilidad precontractual algunos elementos de estudio desde el punto de vista del análisis histórico, que ayuden a una comprensión más amplia del instituto e inciten a su vez a la exploración más profunda, por parte de nuestra doctrina, de puntos de vista hasta ahora desatendidos debido a la preponderancia de las referencias a la célebre pero al mismo tiempo desconocida teoría del alemán Rudolf von Jhering.

    This article means to bring some elements from the historic analysis to the national debate regarding precontractual liability. This is to foster a better understanding of the subject and incentivize a deeper exploration of little investigated vantage points through the scholars. So far they have received little attention due to the predominant fame of the still little comprehended theory of the German Rudolf von Jhering.
