    El artículo analiza tres puntos del escrito de Ferrajoli «Constitucionalismo principialista y constitucionalismo garantista» en los que existen tensiones no resueltas: el primero, relativo al objetivismo moral, el segundo al positivismo jurídico, sea como enfoque metodológico sea como ideología sobre el Derecho, y, en fin, el último al problema de la interpretación jurídica.

    The paper analyzes three points in the Ferrajoli’s essay, «Constitucionalismo principialista y constitucionalismo garantista», in which there are tensions not resolved: the first one related to moral objectivism, the second to legal positivism, understood either as a methodological approach or as an ideology about Law, and, the last one related to the problem of legal interpretation.
