A legal relationship must submit three elements: the subjective, objective and finalistic, so you can be protected by the Code of Consumer Protection. Thus, we are faced with a legal relationship of consumption. The subjective element relates to the poles of this relationship: the consumer and the supplier.
By taking care of the explanation of the concept given to the consumer, the Consumer Protection Code, the consumerist doctrine came into disagreement when it comes to determining whom and under what circumstances, would be the "final destination " spelled out in Article 2 of the Code of Brazilian consumers.
The doctrine was divided to the point of introducing divergent doctrinal trends to determine the "ultimate consignee" who acquires or uses the product or service. Namely, there are three doctrinal streams, each with its own theory, to define the concept of consumer: the finalist, the maximalist and the mixed.
The operator must have the right to adequate science on the conceptualization of the consumer, to thus to distinguish accurately, when a legal relationship should be protected by law Consumerista or civil law.

A saber, existem três correntes doutrinárias, cada uma com sua própria teoria, para definir a conceituação de consumidor: a finalista, a maximalista e a mista.
O operador do Direito deve ter a adequada ciência sobre a conceituação do consumidor, para, assim, saber distinguir de forma correta, quando uma relação jurídica deverá ser tutelada pelo Direito Consumerista ou pelo Direito Civil.
